bicicletta stava percorrendo un piazzale interno della <SPAN
class=SpellE>Tenaris</SPAN> <SPAN class=SpellE>Dalmine</SPAN> per cominciare il
turno di lavoro, era stato investito e ucciso da un camion.

un anno di reclusione S. F., all’epoca del fatto responsabile della sicurezza

class=SpellE>Tenaris</SPAN> <SPAN class=SpellE>Dalmine</SPAN></st1:PersonName>,
assistito dagli avvocati Enrico <SPAN class=SpellE>Matropietro</SPAN> e Giuseppe
Carbone; dieci mesi di reclusione invece per E. G., la legale rappresentante
della ditta proprietaria <SPAN class=SpellE>deI</SPAN> camion che aveva travolto
il giovane, assistita a processo dagli avvocati Giovanni Ponte e Perla <SPAN
class=SpellE>Sciretti</SPAN>; <o:p></o:p></SPAN></B></SPAN></FONT></P>
<P style="MARGIN-BOTTOM: 12pt"><SPAN class=GramE><FONT face="Times New Roman"
size=4><SPAN style="FONT-SIZE: 14pt">un</SPAN></FONT></SPAN><FONT size=4><SPAN
style="FONT-SIZE: 14pt"> anno infine la condanna inflitta al conducente del
mezzo, <SPAN class=SpellE>L.</SPAN> G., difeso dall’avvocato Nicola <SPAN
class=SpellE>Offredi</SPAN> <SPAN class=SpellE>Geddo</SPAN>. Ai primi due, in
ragione dell’<SPAN class=SpellE>incensuratezza</SPAN>, il giudice ha concesso i
benefici della sospensione condizionale e della non menzione della pena, mentre
la condanna dell’autista è stata condonata per effetto dell’indulto.

giudice ha anche stabilito un risarcimento in favore della parte civile
costituita, la sigla sindacale <SPAN class=SpellE>Slal</SPAN> <SPAN
class=SpellE>Cobas</SPAN> con l’avvocato Massimo Rocchi: a fronte di una
richiesta di 100 mila euro di risarcimento, in via <SPAN
class=SpellE>equitativa</SPAN>, il risarcimento è stato fissato in 10 mila euro
complessivi, oltre alle spese legali. <BR

risale al 2004: Pierpaolo Testa [la cui famiglia è stata risarcita circa due
anni dopo il fatto dalle assicurazioni della <SPAN class=SpellE>Dalmine</SPAN> e
della ditta <SPAN class=GramE>di </SPAN><SPAN class=SpellE>au</SPAN> <SPAN
class=SpellE>totrasporti</SPAN>) </SPAN></FONT></B><FONT size=4><SPAN
style="FONT-SIZE: 14pt">doveva cominciare il suo turno di lavoro ed era arrivato
allo stabilimento in bicicletta. <SPAN class=GramE>Mentre</SPAN> attraversava un
piazzale diretto verso gli spogliatoi, era stato colpito da un camion che stava
uscendo da un capannone. <o:p></o:p></SPAN></FONT></P>
<P style="MARGIN-BOTTOM: 12pt"><SPAN class=GramE><FONT face="Times New Roman"
size=4><SPAN style="FONT-SIZE: 14pt">il</SPAN></FONT></SPAN><FONT size=4><SPAN
style="FONT-SIZE: 14pt"> giovane ha riportato ferite molto gravi ed era morto.
Le successive indagini avevano individuato come presunti responsabili
dell’accaduto i tre imputati, che <SPAN class=GramE>hanno sempre respinto</SPAN>
le accuse: l’allora responsabile della sicurezza per <st1:PersonName w:st="on"
ProductID="la Dalmine">la <SPAN class=SpellE>Dalmine</SPAN></st1:PersonName> e
la legale rappresentante della ditta di autotrasporti sostenendo tra l’altro la
mancata osservanza da parte dell’autista delle norme viabilistiche interne, e
questi invece spiegando di aver correttamente seguito quelle a sua conoscenza e
di non aver potuto far nulla per evitare l’impatto.
